Both national and international experts serve and lead the Arbitration Council Foundation (ACF): ACF Board of Directors, Executive Management Team & International Advisory Board.

The ACF is overseen by a Board of Directors. Three of the Directors are Arbitrators currently serving on the Arbitration Council (one from each of the three arbitrator lists; employer, union and ministry). The other Board members include two external Directors, appointed by a majority vote of all the Arbitrators. A representative of the International Labour Organisation also sits as a non-voting member on the Board.

The Executive Management Team (EMT) of the ACF is comprised of the Executive Director, the Managers of each department and a Technical Advisor. The EMT is responsible for all Arbitration Council and ACF operations outside of the hearing room and Secretariat of the Arbitration Council activities.

An International Advisory Board (IAB) guides and mentors the Arbitration Council Foundation to advance the Arbitration Council’s institutional development. The IAB provides recommendations on complex legal issues, extends fund-raising and networking opportunities with potential partners and assists in providing professional development for all Arbitration Council members and staff of the ACF and Secretariat of the Arbitration Council to maintain international standard services. The IAB currently comprises 5 members renowned for their integrity and extensive experience in industrial relations both nationally and internationally.


Mr. MEN Nimmith

Executive Director

Mr. Men Nimmith serves as Executive Director of the Arbitration Council Foundation and is the head of the Executive Management Team. He represents the interests of ACF in communications with the tripartite partners (trade unions, employers’ associations and government, especially the Ministry of Labor and Vocational Training), civil society and private sector, donors, diplomatic missions and other stakeholders, beneficiaries and partners. He is also an arbitrator of the Arbitration Council; he has voluntarily suspended his arbitration duties while serving as Acting Executive Director. He previously served as Executive Director of ACF (from 2005 to 2009); and worked with the European Commission, Cambodia; USAID/Cambodia; and UNTAC. He was a PhD candidate and researcher at the University of Melbourne, Australia; and holds a Master Degree of Science from Northeastern University, Massachusetts, United States of America; Bachelor of Law from National University of Management, Cambodia and Bachelor of Public Administration from the Institute of Public Administration. He has received various awards including: AusAID Australian Leadership Award and U.S. State Department Fulbright Scholarship. 

Ms. CHHIV Phyrum

Mr. PEN Savat

Chief of the Secretariat of the Arbitration Council

Mr. PEN Savat became the Chief of the Secretariat of the Arbitration Council in 2016, previously an officer of the Secretariat since 2007 and also the Deputy of Labour Office of the Department of Labour Dispute. Mr. Savat comes with expertise in case management, administrative work and conciliation of labour disputes.

In addition, he has understanding of Cambodian industrial relations, Cambodian arbitration processes capacity building through stakeholder engagement and training, and communication with disputant parties and liaison between parties and arbitration panels.

He holds a Masters' degree in Law & Political Science from Build Bright University; and Bachelor’s Degree in Program and Project Management also from Build Bright University, and a Bachelor of Law from Norton University.

Ms. CHUM Charya

Ms. Chum Charya serves as Director of Legal Services, is a member of the Executive Management Team, and manages the Legal Services Department (LSD). She is in charge of all legal affairs and manages the provision of legal services, including: directing legal support to arbitral panels; supervising LSD staff, developing and conducting training, overseeing the preparation of legal publications, and developing and implementing the team work plan for case management. She holds a Master of Laws degree from Temple University, Beasley School of Law, in the United States of America, and Bachelor of Laws degree from the Royal University of Law and Economics (RULE). She was selected to participate in the Research Scholarship Program for Law and Development at the University of Michigan, Law School, in the United States. Ms. TENG Ratana

Ms. Teng Ratana serves as Manager of Finance & Administration, is a member of the Executive Management Team, and manages the Finance and Administration Department (FAD). She has expertise and experience in financial management, project management, planning, budgeting and control, administration and HR management. Her previous experience includes being the Finance Manager - Project Support Unit, Ministry of Agriculture, Forestry and Fisheries for three government projects on agricultural development which were funded by International Fund for Agricultural Development (IFAD) and Canadian International Development Agency (CIDA). She earned a Bachelor of Business Administration degree majoring in Finance and Banking from the National University of Management and is pursuing the Association of Chartered Certified Accountant (ACCA) program with CamEd Business School for qualification as a Certified Public Accountant (CPA).

Mr. OK Serei Sopheak

Mr. OK SEREI Sopheak, Director, is a medical doctor and a governance expert serving as a consultant for many national and international organisations including the World Bank, UNDP, AusAID, NCDD and USAID. He obtained his medical degree in Paris, France. He has served as the Adviser and Director of the Cabinet to the Deputy Prime Minister and Minister of Interior; and as Peace and Development Coordinator for the Cambodian Development Resource Institute (CDRI), where he initiated programs on Conflict Prevention in the Cambodian elections (COPCEL). He is the current Chairman of Transparency International, Cambodia.

Mr. RATH Sophoan

Mr. RATH Sophoan, Director, is currently serving as Operations Director, Hong Leong Bank (Cambodia) Plc. and also a board member of Transparency International, Cambodia. Mr. Sophoan holds a Masters of Law from National University of Singapore (NUS ASEAN Fellow) and a Bachelor of Business Law from National Institute of Management and San Francisco Law School. He previously worked with USAID as a Project Management Specialist and then undertook a number of managerial positions at the ANZ Royal Bank. Mr. Sophoan received two Meritorious Honor Awards from USAID Mission Director and U.S. Ambassador for outstanding performance and dedication during a challenging and difficult period. Mr. HUN Chenda

Manager, Monitoring & Evaluation

Mr. Hun Chenda serves as Monitoring and Evaluation Coordinator and is a member of the Executive Management Team. He has expertise in designing, developing, analyzing and implementing the project monitoring and evaluation, strategic planning, reporting and ensuring effectiveness of M&E system. He has a comprehensive knowledge of data analysis, monitoring and evaluation. Prior to this, he was the Data Manager at CARE International in Cambodia and assisted the Monitoring and Evaluation Manager at the World Bank. He earned a Bachelor of Science, Computer Science & Engineering degree and a Bachelor of Arts in Sociology degree from the Royal University of Phnom Penh (RUPP). He is pursuing a Master of Arts, Sociology and Anthropology degree majoring in Rural Development at RUPP.

Mr. John RITCHOTTE

Non-Voting Member, Board of Directors

Mr. John Ritchotte joined the International Labour Organization in 1999. His responsibilities centered on the design and management of technical cooperation projects mostly focused on promotion of freedom of association and collective bargaining through changes to the legal framework and industrial relations practices.

In January 2006, he moved to Phnom Penh to take up the post as manager for a project on labour dispute resolution. His efforts focused on sustaining the Arbitration Council and on promoting improved industrial relations through collective bargaining. In May 2009, Mr. Ritchotte moved to the ILO office in Bangkok as the specialist in industrial relations and labour administration, with responsibilities for countries in the sub-region. Prior to joining the ILO, he worked for 3 years as the international labour specialist at the US Council for International Business, the US employers' association.

Ms. ANN Vireak

Manager of Training and Communications

Ms. Ann Vireak serves as Manager of Training and Communications, is a member of the Executive Management Team, and manages the Training and Communications Department (TCD). She is also an arbitrator of the Arbitration Council and licensed attorney-at-law. She has extensive experience and skills, including developing and conducting training and capacity building programs on subjects ranging from Conflict Management, Leadership Development, Human Resource Management, Cambodian Labor Law, Communications and Facilitation Skills and other related topics. She has worked closely with different organization senior managers in coaching and advising them in the areas of Labor Law, human resource management, training and development.  She was previously the Executive Director of the local NGO, Integrating Human to Quality (IHQ). She obtained her Master Business Administration in Cambodia, was selected to for the Legal Research Program at the University of Michigan Law School and also had undertaken mediation and negotiation skills training in Australia.

Allen PONAK

Adjunct Professor of the University of Saskatchewan in Canada and President of the ‘National Academy of Arbitrators’

Allen Ponak is a Canadian national who has been arbitrating and mediating labour and employment disputes since 1985. He is a listed arbitrator in national and regional collective agreements and was part time vice-chair of the federal Public Service Labour Relations Board from 2008 to 2012. In 1992, Dr. Ponak was admitted to the National Academy of Arbitrators and has served on its Board of Governors, as vice president, and as chair of the Canadian region. He is currently president of the NAA's Research and Education Foundation. In October 2013 he was nominated as NAA president, a position he will assume in May 2015.

Until June 2006, Dr. Ponak was a professor of industrial relations at the University of Calgary and the author of numerous articles, book chapters, and textbooks on union-management relations. He now holds professor emeritus status in that institution and in 2010 he became an adjunct professor at the University of Saskatchewan where he teaches a course in labour and employment arbitration to business and law students. He was president of the Canadian Industrial Relations Association in 1990 and is chair of the editorial board of the journal Relations industrielles. In 2006, his film "Beyond Collision: High Integrity Labour Relations" won the Silver Screen Award at the Los Angeles International Film and Video Festival. He has a B.A. from McGill University, a Master's from Michigan State University, and a Ph.D. in industrial relations from the University of Wisconsin (Madison).

Michael GAY

Commissioner Michael Gay is a member of the Tasmanian Industrial Commission, sitting solely at the Full Bench level. Notably, Michael has extensive international experience in professional development work, having worked in China, Cambodia, East Africa, Tanzania and Zanzibar. Within Cambodia, Michael’s experience has been significant - he is a member of the Arbitration Council Foundation’s International Advisory Board and in 2012, was invested in the Knight of the Royal Order of Sahametrei by the Royal Government of Cambodia for his contributions to the country. Mr. SOK Lor

Managing Director of Sok Xing & Hwang, former Executive Director of Arbitration Council Foundation

Mr. Sok Lor is the founder of Sok Xing & Hwang law and policy firm. A leader in labour and employment law and policy, the firm stands at the vanguard in the areas of labour market governance and industrial relations in Cambodia. As its Managing Director, he leveraged his team’s expertise and experience to facilitate strategic investments in labour-intensive industries through legal services that encompass the entire business investment cycle. 

Prior to founding Sok Xing & Hwang, Mr. Sok served at the Arbitration Council Foundation as its Chief Legal Officer, Deputy Executive Director, and subsequently Executive Director. In the latter role, he was responsible for setting and executing strategies toward improved credibility and effectiveness of the national Arbitration Council. Amid rising challenges in industrial relations environment in Cambodia and pressing needs for the Arbitration Council’s financial continuity, he mobilized various policy participants and supporters to address them. These include a number of governmental institutions; international development agencies that cover the World Bank, SIDA, USAID, SDC; and corporate social responsibility foundations of international brands that span across Gap Foundation and Levi Strauss Foundation. While heading the Arbitration Council Foundation, he also took charge of shepherding the execution of the World Bank-funded Demand for Good Governance project of the Cambodian government for the component that supported the intensification and expansion of the Arbitration Council’s dispute resolution work in Cambodia. These efforts earned him the gold medal awarded by the Cambodian government. 

A thought leader in Cambodian labour law and industrial relations policy, Mr. Sok has diverse areas of expertise that extend across labour law and industrial relations policy, alternative dispute resolution and dispute system design, mediation of labour disputes, legislative research and drafting, organizational and business strategies, and project management.
